Court of Protection Solicitor / Full-time | Hybrid Working

An excellent opportunity has arisen for an experienced Court of Protection Solicitor to join a highly respected specialist firm supporting some of the most vulnerable individuals in society.

This role is ideal for a solicitor with substantial welfare and s21A experience who is passionate about protecting the rights, autonomy, and best interests of people who lack capacity.

About the Firm

The firm specialises in representing vulnerable people, including those detained under the Mental Health Act or lacking capacity to make key decisions. Their work spans Mental Health Tribunals, welfare and financial Court of Protection matters, deputyship work, and Lasting Powers of Attorney. They also deliver training to professionals across legal, health, and social care sectors.

You’ll be joining a supportive, knowledgeable team committed to delivering high-quality, person-centred legal services.

The Role

You will manage a predominantly welfare and section 21A caseload, providing expert legal advice and representation.

Key responsibilities include:

  • Managing complex Court of Protection matters, primarily welfare and s21A
  • Advising and supporting individuals who lack capacity regarding care, treatment, and living arrangements
  • Visiting clients in care homes, hospitals, and other settings
  • Drafting Court of Protection applications, statements, and related documents
  • Representing clients at hearings and conferences with Counsel
  • Advising on capacity assessments, best interests decisions, and appropriate legal pathways
  • Ensuring compliance with the Mental Capacity Act 2005, CoP rules, and relevant guidance
  • Managing caseloads efficiently and progressing matters appropriately
  • Preparing and managing Legal Aid case plans
  • Ensuring accurate and timely billing in line with LAA requirements

What We’re Looking For

  • Qualified solicitor (England & Wales)
  • Minimum 4 years’ PQE in complex Court of Protection work
  • Strong experience in welfare and s21A cases
  • Solid understanding of Legal Aid funding and case planning
  • Proven ability to manage demanding caseloads and meet deadlines
  • Experience supervising, delegating, or leading within a team
  • Excellent communication skills with the ability to engage sensitively with vulnerable clients
  • Strong organisational and time-management skills

Desirable:

  • Accredited Legal Representative (ALR) status
  • Broader Court of Protection experience beyond welfare and s21A
